I was sure — and Google confirms — that Justice Breyer was on Charlie Rose in 2005. He was at that time clearly a man of long experience on the Supreme Court.
There was no way he could have been elected only in 2004 when Obama was elected to the Senate.

Breyer was appointed to the Supreme Court by Bill Clinton in 1994– before Obama was in public office.
Senator McCain probably meant Justice Alito.

This one hit me between the eyes.
